TERMS AND CONDITIONS

1. General principles and definitions

  • Marlon Marketing S.L.U (hereinafter “MM”) owns the website http://www.socialdogcat.com (hereinafter “Site”) and the domain “Socialdogcat.com”, as well as being the exclusive holder of all rights of use thereof;
  • The use of the Site’s content and the services offered therein (hereinafter “the services” or “the service”) is subject to full compliance with the terms and conditions set out below;
  • MM reserves the right to modify the conditions at its sole discretion, informing users by publishing them on the Site. Each user must periodically check the conditions to ascertain whether any changes have been made since the last consultation. In any event, use of the Site and its services implies acceptance of any changes made in the meantime;
  • MM reserves the right to make specific sections of the Site available only to specific categories of people (in particular, its customers or those who have registered on the Site, according to the procedures defined by MM);
  • A registered user may revoke their registration at any time by sending an email to the following address info@socialdogcat.com;
  • MM reserves the right to modify, suspend or discontinue, even partially, the services, including access to the database or content. MM also reserves the right to introduce access or service limitations, in whole or in part, without notice and without assuming liability in this regard.

2. Site content and use by users

  • The Site’s content is intended for personal and non-professional use. All materials published on the Site (including, by way of example, informational articles, photographs, images, illustrations, audio and video recordings, hereinafter also referred to as “content”) are protected by copyright laws and are owned by MM or by the respective rights holders. Users must comply with any additional information that may appear on the Site regarding the intellectual property of content accessed through the Site’s services;
  • The Site’s services and content are protected by copyright laws, as well as by international laws and conventions. Users are not authorized to modify, publish, transmit, share, assign for use in any capacity, reproduce (beyond the limits specified below), rework, distribute, perform, grant access to or commercially exploit in any way the Site’s content or services (including the software), even partially;
  • For personal use only, users are authorized to download or copy the content and any other downloadable material available through the Site’s services, provided that all copyright notices and other notices shown on the Site are faithfully reproduced. Reproduction and collection of any content for purposes other than personal use is expressly prohibited in the absence of prior express written authorization from MM or the copyright holder identified on the Site;
  • Content originating from other sources or websites is published by MM, which assumes no responsibility for incompleteness, inaccuracies, errors or omissions regarding the completeness of the information and is not liable for any resulting damage.

3. Possible podcast services

  • Any podcast services, consisting of informational content that can be downloaded as mp3 files and played on portable devices, are made accessible through the Site for personal use only, and any commercial use is excluded. Any other use, including, by way of example, the insertion of advertising messages, association with products or widespread distribution for advertising purposes, is prohibited in any form. Users may not in any way modify or distribute the podcast services or links originating from the Site to third parties;
  • The podcast services and related content are protected by Italian copyright laws and related international laws and conventions. MM holds all exploitation rights to the trademarks used in connection with the services. MM reserves the right to discontinue the podcast service at any time and to terminate the user’s use, in any form, of the downloaded material, without limitation and without notice; MM assumes no responsibility regarding the content and podcast services or their use in relation to damage or usage limitations.

4. Forums, discussions and user-generated content

  • Users may not submit, distribute or otherwise publish in accessible areas (hereinafter “Forums”) content that is defamatory, libelous, obscene, pornographic, abusive or illegal for any reason.
  • Users undertake not to adopt violent or aggressive attitudes toward other users, refraining from using insulting or libelous terms and from intentionally interrupting discussions with repetitive, unjustified messages lacking meaning in the context, or with initiatives of any kind intended to sell and/or promote products or services. Users undertake to use respectful language, bearing in mind that forums thrive only when their members feel welcome and respected.
  • Users undertake not to use violent, vulgar, obscene, offensive or discriminatory terms based on race, religion, gender, sexual orientation, physical or mental disabilities or otherwise. Use of such language will result in immediate suspension and expulsion from all or part of the Site’s services.
  • Users undertake to accept discussions while avoiding conflict. In a community that is free and open to everyone’s discussions and opinions, it is natural that people may disagree. MM encourages passionate discussions and welcomes discussions in its Forums provided that they remain civil and respectful toward everyone. Any confrontational behavior will be considered a direct violation of the rules of conduct and will justify immediate and permanent expulsion from all or some of the Site’s services. Forums may be used only for non-commercial purposes. Without MM’s express authorization, every user must refrain from disseminating or distributing by any means messages containing commercial offers of any nature. Users are personally responsible for the content of their messages. MM is obviously unable to ensure precise monitoring of every message distributed in the forums and is therefore not responsible for their content; in any event, it reserves the right to delete, move or modify messages that, at its sole discretion, appear abusive, defamatory, obscene or infringe copyright or trademark rights, and in any event are unacceptable for the purposes of the Site.
  • Users acknowledge and agree that any material submitted for participation in the Site’s services (including, by way of example but not limitation, submitting comments, expressing opinions, participating in surveys and initiatives, and submitting video and audio files) may be modified, removed, modified, published, transmitted and performed by MM. Users therefore waive any economic and moral rights they may have as authors in relation to modifications made to such material, even where the modifications have not been approved by the author. In particular, with regard to video files, the user grants MM an unlimited, non-exclusive right of use, without geographical limitations. MM may therefore, directly or through trusted third parties, use, copy, transmit, extract, publish, distribute, publicly perform, disseminate, create derivative works, host, index, store, annotate, encode, modify and adapt (including, without limitation, the right to adapt for use in streaming, downloading or transmission through any means of communication), in any form or using any instrument currently known or hereafter invented, any message, including audio and video, submitted by the user, including through third parties. By submitting any material, the user authorizes its publication on the Site and its use by MM, without any limitation, including for its own promotional and commercial purposes.

5. Access to and availability of the service. Use of links

  • The Site contains links to other resources on the internet. MM is not responsible for the actual accessibility or availability of such resources outside its Site, nor for their content. Users are therefore invited to contact the administrator or webmaster of such external sites if they encounter problems with such content.

6. Liability and warranty statements

  • The user declares, warrants and takes every precaution to ensure that:
  1. a) no material submitted to the Site through their account infringes the rights of third parties, including copyright, trademark protection, privacy or any other personal or economic right.
  2. b) Content is submitted by adults. For minors, materials must be reviewed and authorized by those exercising parental authority. Consequently, the user shall indemnify and hold harmless MM, the Site operator and all parties connected with them from and against any liability and detrimental consequence, including, without exception, legal costs calculated according to the professional fee schedule incurred by MM as a result of legal actions arising from the user’s breach of these obligations in relation to misuse by the user or third parties of their account in violation of the warranties set forth in this article. Otherwise, the user shall be responsible for all damage and expenses. In any event, the user must provide MM with all cooperation necessary to properly protect its rights in relation to such legal actions. MM reserves the right to protect itself independently by defending itself in court, at its own expense, without prejudice to its right to claim any indemnification from the user. MM does not in any way guarantee the accuracy or reliability of the opinions, statements, indications or other information published, uploaded or distributed through the Site’s services by any user, information provider or other natural or legal person. Users acknowledge that reliance on the truthfulness and reliability of opinions, statements, indications or information published on the Site is at their own discretion and that they assume the related consequences. The service and all downloadable materials are provided as is, without warranties of any kind, either express or implied, including, without limitation, warranties of title, merchantability and fitness for a particular purpose. Users therefore acknowledge that use of such materials is carried out under their full and exclusive responsibility.

7. Registration and security

  • As part of the registration process, MM may require the user to choose a user ID and password. In such case, the user may be required to provide specific information that must be truthful, accurate and current. The user may not choose another person’s user ID with the intent to misappropriate their identity. Nor may the user use another person’s user ID without their express authorization. The use of user IDs that MM, at its discretion, considers to infringe third-party rights or to be offensive or vulgar is also prohibited. Failure to comply with these rules constitutes a violation of the general terms of use and may result in the immediate cancellation of the account of the person responsible for the violation. Users must ensure the confidentiality of their password, avoiding sharing it with third parties, even if they belong to MM’s organization. In the event of actual or potential unauthorized use of their account, users are invited to report it to info@socialdogcat.com, providing detailed information about the violation and notifying MM of the loss, unauthorized removal or theft of their password and personal information. Users acknowledge that they must be at least 18 years old to register for the service, although people of any age may access it. Minors under 18 must be assisted and authorized by those exercising parental authority. Users are fully responsible for every action taken through their account, whether directly or through third parties authorized by them. Any abusive, fraudulent or otherwise illegal use will result in the immediate cancellation of the account, at MM’s sole discretion, without prejudice to the exercise of any legal action by those entitled to bring it.

8. Service costs and payments

  • Site services are free unless otherwise specifically stated. MM reserves the right to charge a fee for access to sections of the Site or specific services. In any event, MM will not request payment of any fee unless it has first obtained express acceptance of such offer. Therefore, if MM should in the future charge a fee for access to portions of the Site or services that are currently free, the user will first receive a specific notice detailing the costs, giving the user the opportunity to choose whether or not to accept the service. If accepted, the user will pay the fee using the method they choose, at the cost defined when accepting the service. MM also reserves the right to verify registration data and, if such data is not consistent and truthful or if use of the service and/or product may harm the personal dignity of third parties or any other right, to suspend, close and cancel the account, retaining the remaining payment as compensation for damage caused to the Socialdogcat.com portal and to the image, seriousness and fairness of the services/products offered by MM. The user accepts this condition without reservation.

9. Communications between MM and the user

  • If the user indicates on the registration form that they wish to receive information from MM and related parties, with their consent and in compliance with applicable law, the user’s personal data, freely provided by them, may be used to send promotional material relating to such parties. MM reserves the right in any event to send the user communications by email to inform them of changes or additions concerning the Site and its related services. Statistical data and data relating to use of the Site, once anonymized, may be used by MM for research and analysis activities. For further details, users may consult the privacy policy. MM may contact the user by email to participate in surveys and request feedback on the Site and/or existing or future products and services. Such information will not be shared with third parties, except in aggregated form, and will be used only to improve the Site and its services.

10. Software use licenses

  • The user acquires no rights in relation to the use of software present on the Site, but only a limited right to use it as necessary to access the services. The user may therefore not grant rights of use, assign or transfer licenses in relation to such software. The user is authorized solely to make a copy of the software for personal use, without prejudice to the prohibition on distributing, modifying, reworking or creating derivative works from such software.

11. Account duration

  • The user may request cancellation of their account at any time by sending an email to info@socialdogcat.com. After cancellation, the user will receive an automatic confirmation email acknowledging receipt of the request, specifying that the account will be deactivated within the following twenty-four hours. It is understood that the user is responsible for all activities carried out through the account until the time of actual deactivation. MM may, at its discretion, cancel or temporarily suspend access to all or part of the Site and services for any reason, including, without limitation, any violation of the rules described in these conditions of access to the service.

12. Miscellaneous

  • These conditions of access have been drafted in accordance with the laws in force in Spain. All disputes arising from the interpretation or performance of this agreement shall be submitted exclusively to the jurisdiction of the Court of Las Palmas de G.C. These conditions of access shall be applied and interpreted in accordance with the other general rules established on the Site and with the laws in force in Spain. For any communication concerning these conditions of access, the user may write to info@socialdogcat.com. The user undertakes to report to MM any violation by third parties relating to these conditions of access as soon as they become aware of it. In particular, in the event of legal actions concerning copyright infringement in relation to materials published on the Site or through connected services, the user is invited to report any information in their possession to info@socialdogcat.com

13. Processing of personal data

  • In accordance with the provisions of Spanish legislation on the processing of personal data, processing shall be carried out in strict compliance with the applicable provisions. In particular:
  1. Data is collected and processed by MM for the purposes of marketing and advertising, sending informational and promotional material, and statistical analysis.
  2. Data processing for the above purposes will take place using both automated and manual methods.,
  3. Providing the Data is entirely voluntary for users
  4. Users have the right to: know the purposes and methods of processing; know the identifying details of the data controller; know the persons or categories of persons to whom personal data may be disclosed or who may become aware of it as representatives, data processors or authorized personnel; request that data be updated or corrected; request the deletion, anonymization or blocking of data processed unlawfully, including data that need not be retained in relation to the purposes for which it was collected or subsequently processed; and object, in whole or in part, on legitimate grounds, to the processing of personal data, as well as to the processing of personal data for the purpose of sending advertising or sales materials, conducting market research or commercial communications;
